🚨NEWS: The National Fraternal Order of Police, one of the key law enforcement groups involved in negotiations over the Blockchain Regulatory Certainty Act, is now backing the latest version of the Clarity Act, saying revised BRCA language addresses its previous concerns and preserves law enforcement’s ability to investigate crypto crimes. The BRCA remained unchanged in the latest version of the bill released Wednesday, so it’s unclear what changes the group is referencing.

SENATOR URGES SENATE TO KEEP NON-CUSTODIAL BITCOIN DEVELOPER PROTECTIONS IN CLARITY ACT Sen. Ron Wyden urged Senate leaders to preserve the BRCA provision in the CLARITY Act, warning that removing protections for non-custodial, open-source developers would undermine legal certainty for Bitcoin and crypto software while doing little to combat illicit finance. Wyden argued developers who never control user funds should not be treated as money transmitters.

The CLARITY Act nearly died Thursday morning. Negotiations between Republicans and Democrats collapsed Wednesday night after talks stalled over changes to the BRCA, which protects noncustodial software developers from money transmitter prosecution. Thursday morning, the five pro-crypto Democrats met in Warner's office to strategize. "Members were still hashing it out as late as 10:29 a.m." The hearing started at 10:30. The deal came together in the ante room right after Warren's opening statement. Senators Tillis, Lummis, Alsobrooks, and Gallego struck a last-minute compromise while GOP aides handwrote draft amendments and rushed printed materials to members in real time. One staffer called it "chaotic and unprecedented." The compromise removed BRCA-referencing language from Section 301, which DeFi advocates say could weaken developer protections. Other revisions authorized banks to engage in digital asset activities, banned insider trading on ancillary assets, and preserved state consumer protection laws. The bill passed 15-9. Both Democratic yes votes made clear their support doesn't carry to the floor. Gallego: "My vote here does not guarantee a vote on the floor." The bill now gets merged with the Senate Agriculture Committee text before a full Senate vote.

However, the compromise came at the cost of a specific change to a @SenLummis amendment that removed language from Section 301 of the bill referencing the Blockchain Regulatory Certainty Act (BRCA), disappointing some DeFi advocates who say the move could strip out critical protections for software developers as the bill moves forward. Notably, Senator @MarkWarner (D-VA) did not vote to advance the bill despite positively referencing the changes during the markup. That said, Senator @berniemoreno said during the hearing that there’s still work to be done on Section 301, suggesting discussions will continue in the coming weeks as @BankingGOP and @SenateAg work to merge the texts ahead of a full Senate vote.
