🚨SCOOP: Last minute negotiations between Banking Committee Republicans and Democrats over multiple amendments were brokered this morning in an effort to secure bipartisan support for today’s vote on the Clarity Act, multiple sources tell me. However, the compromise came at the cost of a specific change to a @SenLummis amendment that removed language from Section 301 of the bill referencing the Blockchain Regulatory Certainty Act (BRCA), disappointing some DeFi advocates who say the move could strip out critical protections for software developers as the bill moves forward. Notably, Senator @MarkWarner (D-VA) did not vote to advance the bill despite positively referencing the changes during the markup. That said, Senator @berniemoreno said during the hearing that there’s still work to be done on Section 301, suggesting discussions will continue in the coming weeks as @BankingGOP and @SenateAg work to merge the texts ahead of a full Senate vote.

To clarify what's happening: Senate Democrats wanted an amendment vote on bank-supported language to restrict yield, plus law enforcement requested changes. Chair Scott is refusing to hold a vote on those provisions, which would carry political liabilities for Republicans.

And just like that: @SenRubenGallego (D-AZ) says he will vote ‘yes’ today on advancing the Clarity Act to the full Senate, but caveats that his vote here does not translate into a yes vote on the floor. “We have come close but not finished an agreement on ethics guardrails for all elected officials…but if this is not resolved by the time of the floor… I am not afraid to vote no.”

A small update since last night: The 5 pro-crypto Banking Committee Dems gathered this morning to figure out final direction on how to vote in today’s markup after negotiations with GOP colleagues fell through last night, according to three sources. However, hearing it’s likely going to be a collective vote against, driven largely by disagreements over the BRCA after @CortezMasto pushed for changes following support from law enforcement groups this week for her amendments. After everything we heard about ethics this week, it no longer appears to be the central sticking point. Instead, the focus seems to have shifted to whether Democrats believe the Grassley-Lummis backed BRCA compromise goes far enough to address law enforcement concerns. As always, nothing is final until it happens, so we’ll see what the next few hours bring.

Tornado Cash getting a spotlight in today’s hearing as lawmakers debate whether the bill gives law enforcement sufficient tools to combat money laundering. Warren to Kennedy: “It’s the Tornado problem… you remember Tornado, the mixer? What purpose does Tornado serve? Put your money in if you’re a terrorist!” GOP lawmakers argue the Clarity Act provides tools to address this issue, while Warren says the bill doesn’t go far enough. Other Democrats joined her in voting to include the amendment. The amendment did not pass.

Otherwise, when or if another FTX happens, we will have no one to blame but ourselves.” Democrats like @SenAdamSchiff and @SenRubenGallego had been pushing to reach a compromise on ethics/conflicts of interest involving the First Family ahead of tomorrow’s markup as a condition of their support for the bill, while other Democrats voiced eleventh-hour concerns about provisions tied to the Blockchain Regulatory Certainty Act (BRCA), which would prevent non-custodial software developers from being prosecuted under money transmitter laws. It’s my understanding that meaningful progress was made on ethics, but last minute disagreements over BRCA changes ultimately prevented a deal from coming together. Of course, it’s still unclear how the five pro-crypto Democrats on the Banking Committee will ultimately vote tomorrow, but as of now, the expectation is that the markup will be partisan.

🚨NEW: Another one that stands out from @SenJackReed: An amendment that “prohibits crypto from being used as legal tender, for example, to pay taxes.” I think @Rep_Davidson introduced a bill to do that very thing (pay taxes) with $BTC last year. Also, more than 40 amendments from @SenWarren, one that would prevent the Federal Reserve from issuing master accounts to crypto companies.

The deadline for Banking Committee members to file amendments to the Clarity Act text was 5 p.m. ET. Unclear as of now how many were submitted exactly, but for context, there were 137 amendments filed ahead of January’s planned markup, so this time could see as many, if not more.

🚨Mini scoop (with typo fix because I have acute OCD): Senate Minority Leader @SenSchumer attended a Democratic member meeting yesterday where, according to one attendee, he appeared engaged and eager for members to get to a yes on the Clarity Act, but stressed that ethics negotiations need to be further along before Thursday’s markup. On that front, members left a bipartisan meeting this morning where ethics issues were discussed, but there appeared to be no concrete direction emerging from the talks. Discussions likely to continue later this evening. GOP and Democratic staff are expected to meet again to review amendments once all have been filed. The filing deadline is 5 p.m. ET, in about 45 minutes.
