I couldn’t agree more. America won the internet because developers were free to experiment without fearing criminal prosecution for writing code. Yet the Roman Storm case sends the opposite message to every software developer in the world: that you can be prosecuted for creating open-source, non-custodial software because of how third parties choose to use it. In the meantime, the SDNY has shown no sign of backing away. Instead, it has added another prosecutor and is moving full speed ahead to put Storm through a second trial. If America wants to lead the world in blockchain and AI, it cannot continue criminalizing software development. Developers need clear legal protections, not the threat of prison for publishing code.
