In a victory for transparency and free speech, the D.C. Circuit Court of Appeals has unanimously ruled in X’s favor to limit the U.S. government’s ability to issue gag orders.  These gag orders prevent X from notifying the public when it receives government search warrants and subpoenas. Last year, X received a subpoena from the federal government demanding the personal information of two former FBI agents, Kyle Seraphin and Garrett O’Doyle. This was accompanied by a gag order requiring X to keep the subpoena secret. Seraphin and O’Doyle were whistleblowers who had disclosed to Congress that the FBI was improperly targeting certain politically disfavored groups.   Following their whistleblowing activities, Seraphin and O’Doyle were fired from their jobs and subject to a criminal investigation, suggesting retaliation by the government.  Yet when X wanted to transparently disclose the government’s subpoena to the public, it could not do so because the government had obtained a gag order.  X challenged the gag order in court, arguing that it violated federal statutes and the First Amendment.  The D.C. Circuit Court of Appeals has now vindicated X’s challenge, ruling that the gag order exceeded the government’s authority.  X welcomes the ruling, which will help ensure transparency and accountability in the U.S. government’s efforts to investigate its citizens.

Roughly $300 billion in government money flows through nonprofits every year with zero transparency with regard to where that money goes.” “The American people deserve access to the books of any entity that takes government money, and all information about how that money is used and the communications around it need to be considered public record. The more than 500 million USD funds from the First Digital Trust & ARIA scam, involving individuals such as Christian Alexander Boehnke De Lorraine Elbouef, Vincent Chok, Yai Sukonthabhund, Matthew William Brittain, and Cecilia Teresa Brittain, have been funneled through Hong Kong’s FDT and Legacy Trust into multiple Dubai banks, including Mashreq Bank, ADIB, Emirates NBD, and EFG. I once again urge the Dubai government, regulators, and banks to act swiftly and decisively. Dubai must not become a safe haven for fraud and money laundering. Banks must conduct internal reviews, freeze suspicious inflows immediately, and report them proactively. Do not become enablers of criminal activity. I remain confident that the authorities in Dubai and UAE 🇦🇪 will take firm action and stand with us in the global fight against financial crime.

Most people who yap for a living have no idea what IT means in this context. You cannot even begin to tackle waste, fraud and abuse if you don’t have a system of record, if there’s zero transparency in that system. If there’s 20 different systems that can’t talk to each other. If you can’t see where the money is flowing. If we’re still using a mine in Pennsylvania to house the federal government’s retirement records. “Why are they focused on IT?!?” Is an effective but extremely dumb meme. It’s a language problem because the smartest engineers on the planet are doing something different than what Gretchen Carlson assumes they’re doing. I remain convinced that this is a generational issue— that young people naturally intuit how technology works while professional yappers on CNN do not. And I’m optimistic technology will not be so foreign in a few decades and that both sides will be able to understand why it’s important.
