吴说获悉，StarkWare 总法律顾问 Katherine Kirkpatrick Bos 表示，CME 针对 CFTC 永续合约监管决定的诉讼面临法律挑战。《多德-弗兰克法案》并未明确规定永续合约应被归类为期货还是互换，而在美国最高法院 Loper Bright 判决后，监管机构的既有解释也不再自动获得法院尊重。其指出，CFTC 在 Binance 案中将永续合约视为互换的立场并不构成具有约束力的司法先例。
