Biden announced the mandate in September 2021 and OSHA issued it 2 months later as an Emergency Temporary Standard, a fast track tool built for collapsing equipment and chemical leaks. Lawsuits hit immediately, until the Supreme Court finally struck it 6-3 on January 13, 2022. A daily risk everyone faces was never a distinct workplace danger Congress gave OSHA authority to regulate.
