被告人林书铖(曾用名林叔阳),男,1991年9月16日出生,公民身份号码*******,汉族,大学本科文化,户籍所在地山西省*******。因涉嫌非法利用信息网络罪,于2025年10月12日被北海市公安局银海分局刑事拘留,同年11月17日经本院批准逮捕,次日由北海市公安局银海分局执行逮捕。
被告人汪中(曾用名汪忠),男,1967年9月9日出生,公民身份号码*******,汉族,硕士研究生文化,户籍所在地辽宁省*******。因涉嫌非法利用信息网络罪,于2025年10月21日被北海市公安局银海分局刑事拘留,同年11月17日经本院批准逮捕,次日由北海市公安局银海分局执行逮捕。
被告人吴秋雨,女,1989年8月19日出生,公民身份号码*******,汉族,硕士研究生文化,户籍所在地及居住地北京市*******。因涉嫌非法利用信息网络罪,于2025年10月12日被北海市公安局银海分局刑事拘留,同年11月17日经本院批准逮捕,次日由北海市公安局银海分局执行逮捕。
本案由广西壮族自治区北海市公安局银海分局侦查终结,以被告人王林、高颖佳、尹会彬等八人涉嫌诈骗罪、非法经营罪,于2026年6月18日向本院移送审查起诉。本院受理后,于2026年6月19日已告知被告人有权委托辩护人和认罪认罚可能导致的法律后果,依法讯问了被告人,听取了辩护人的意见,审查了全部案件材料。
经依法审查查明:
一、诈骗罪
2007年,金明日(另案处理)未按照国家宗教管理规定向相关管理部门登记和备案,未取得在国内合法传教批准的情况下,在北京市非法成立“北京锡安教会”,被告人王林、高颖佳、尹会彬、王聪、刘桢彬、林书铖等人加入教会共同进行非法宗教活动。
2018年9月9日,“北京锡安教会”被北京市朝阳区民政局依法取缔。金明日、被告人尹会彬等人先后到北海市居住生活并继续开展非法宗教活动。被告人王林、高颖佳、尹会彬、王聪、刘桢彬、林书钺以牧师身份,分别负责长三角牧区、京津冀牧区、长三角和京津冀以外的大牧区、京津冀分牧区、青岛牧区、成都牧区的传教事务。被告人一伙明知教会被取缔且自己不具备合法传教资格,仍冒充宗教教职人员以牧师身份在互联网和线下各地 开展非法传教活动,骗取信徒的“奉献金”人民币(以下均为同一币种)1000余万元。
至案发,被告人王林分得赃款124.405万元,高颖佳分得赃款115.5464万元,尹会彬分得赃款56.3041万元,王聪分得赃款66.632万元,刘桢彬分得赃款64.348万元,林书铖分得赃款32.674万元。
二、非法经营罪
2018年10月,金明日违反国家法律法规等有关规定,非法设立“锡安圣经学院”,被告人王林任院长,被告人汪中任行政院长,被告人吴秋雨任教务长,自2020年至2025年,未经许可利用信息网络非法销售涉宗教等内容的“课程包”,收取非法经营款200余万元。
至案发,被告人王林分得非法经营款42.7万元,汪中分得非法经营款14.1万元,吴秋雨分得非法经营款39.9万元。
认定上述事实的证据如下:
1.物证:扣押的手机、电脑等;2.书证:户籍信息、取缔决定书等;3.被害人陈述:*******等人的陈述;4.证人证言:*******等证人的证言;5.被告人供述和辩解:王林、高颖佳、尹会彬等人的供述和辩解;6.搜查、辨认等笔录:搜查 笔录、辨认笔录等;7.视听资料、电子数据:授课视频、电子检材报告、银行流水、微信、支付宝交易明细等。
本院认为,被告人王林、高颖佳、尹会彬、王聪、刘桢彬、 林书钺以非法占有为目的,虚构事实、隐瞒真相,骗取他人财物, 数额特别巨大,其行为触犯了《中华人民共和国刑法》第二百六 十六条,犯罪事实清楚,证据确实、充分,应当以诈骗罪追究其刑事责任。被告人王林、汪中、吴秋雨违反国家规定,实施严重扰乱市场秩序的非法经营行为,情节特别严重,其行为触犯了《中华人民共和国刑法》第二百二十五条第(四)项,犯罪事实清楚,证据确实、充分,应当以非法经营罪追究其刑事责任。被告人王林、高颖佳、尹会彬、王聪、刘桢彬、林书钺共同故意实施诈骗的犯罪行为,被告人王林、汪中、吴秋雨共同故意实施非法经营的犯罪行为,依照《中华人民共和国刑法》第二十五条第一款之规定,是共同犯罪。被告人王林在共同诈骗、非法经营犯罪活动中起主要作用,被告人高颖佳、尹会彬在共同诈骗犯罪活动中起主要作用,依照《中华人民共和国刑法》第二十六条第一款、第四款之规定,是主犯,应当按照其所参与的全部犯罪处罚;被告人王聪、刘桢彬、林书铖在共同诈骗犯罪活动中起次要作用,被告人汪中、吴秋雨在共同非法经营犯罪活动中起次要作用,依照《中华人民共和国刑法》第二十七条之规定,是从犯,应当从轻或者减轻处罚。被告人王林、高颖佳、尹会彬、刘桢彬、林书铖、汪中、吴秋雨归案后如实供述自己的罪行,依照《中华人民共和国刑法》第六十七条第三款之规定,系坦白,可以从轻处罚。被告人王林在判决宣告以前一人犯数罪,依照《中华人民共和国刑法》第六十九条之规定,应当数罪并罚。被告人汪中自愿认罪认罚,依照《中华人民共和国刑事诉讼法》第十五条之规定,可以从宽处理。根据《中华人民共和国刑事诉讼法》第一百七十六条之规定,提起公诉,请依法判处。

The investigation of this case was concluded by the Yinhai Branch of the Beihai Municipal Public Security Bureau, which transferred the case to this Procuratorate for examination for prosecution on June 18, 2026, on suspicion that defendants Wang Lin, Gao Yingjia, Yin Huibin, and the other five defendants had committed the crimes of fraud and illegal business operations. After accepting the case, this Procuratorate informed the defendants on June 19, 2026, of their right to retain defense counsel and of the possible legal consequences of pleading guilty and accepting punishment, interrogated the defendants in accordance with law, heard the opinions of defense counsel, and examined all case materials.
Upon examination in accordance with law, the following facts have been ascertained:
I. Crime of Fraud
In 2007, Jin Mingri (金明日, handled in a separate case), without registering or filing with the relevant administrative authorities as required by the State’s regulations on religious affairs and without obtaining approval to lawfully conduct religious preaching within China, unlawfully established the “Beijing Zion Church” in Beijing. Defendants Wang Lin, Gao Yingjia, Yin Huibin, Wang Cong, Liu Zhenbin, Lin Shucheng, and others joined the church and jointly engaged in unlawful religious activities.
On September 9, 2018, the “Beijing Zion Church” was banned pursuant to law by the Civil Affairs Bureau of Chaoyang District, Beijing. Thereafter, Jin Mingri, defendant Yin Huibin, and others successively moved to and resided in Beihai City, where they continued to conduct unlawful religious activities. Acting as pastors, defendants Wang Lin, Gao Yingjia, Yin Huibin, Wang Cong, Liu Zhenbin, and Lin Shucheng were respectively responsible for religious preaching affairs in the Yangtze River Delta pastoral region, the Beijing-Tianjin-Hebei pastoral region, the broader pastoral region outside the Yangtze River Delta and Beijing-Tianjin-Hebei, the Beijing-Tianjin-Hebei sub-region, the Qingdao pastoral region, and the Chengdu pastoral region.
Although they knew that the church had been banned and that they lacked lawful qualifications to preach, the defendants nevertheless falsely held themselves out as qualified religious clergy and, acting as pastors, conducted unlawful preaching activities on the internet and offline in various locations, thereby fraudulently obtaining more than RMB 10 million in “offerings” from congregants.
By the time the case was uncovered, defendant Wang Lin had received RMB 1,244,050 in criminal proceeds; Gao Yingjia, RMB 1,155,464; Yin Huibin, RMB 563,041; Wang Cong, RMB 666,320; Liu Zhenbin, RMB 643,480; and Lin Shucheng, RMB 326,740.
II. Crime of Illegal Business Operations
In October 2018, Jin Mingri, in violation of relevant State laws and regulations, unlawfully established the “Zion Bible College.” Defendant Wang Lin served as president, defendant Wang Zhong as administrative dean, and defendant Wu Qiuyu as academic dean. From 2020 through 2025, without authorization, they used information networks to unlawfully sell “course packages” containing religious and related content and collected more than RMB 2 million in proceeds from illegal business operations.
By the time the case was uncovered, defendant Wang Lin had received RMB 427,000 in proceeds from illegal business operations; Wang Zhong, RMB 141,000; and Wu Qiuyu, RMB 399,000.
The evidence establishing the foregoing facts includes:
1. Physical evidence: seized mobile phones, computers, and other items;
2. Documentary evidence: household registration information, the decision to ban the organization, and other documents;
3. Statements of victims: statements by … and others;
4. Witness testimony: testimony by … and other witnesses;
5. Statements and defenses of the defendants: statements and defenses by Wang Lin, Gao Yingjia, Yin Huibin, and others;
6. Records of searches, identifications, and other investigative acts: search records, identification records, and related records; and
7. Audio-visual materials and electronic data: lecture videos, electronic evidence examination reports, bank transaction records, and WeChat and Alipay transaction details.
This Procuratorate finds that defendants Wang Lin, Gao Yingjia, Yin Huibin, Wang Cong, Liu Zhenbin, and Lin Shucheng, with the purpose of unlawful possession, fabricated facts, concealed the truth, and fraudulently obtained property from others, with the amount involved being especially huge. Their conduct violates Article 266 of the Criminal Law of the People’s Republic of China. The facts of the crimes are clear, and the evidence is reliable and sufficient; they shall therefore be held criminally liable for the crime of fraud.
Defendants Wang Lin, Wang Zhong, and Wu Qiuyu, in violation of State regulations, engaged in illegal business operations that seriously disrupted market order, under especially serious circumstances. Their conduct violates Article 225(4) of the Criminal Law of the People’s Republic of China. The facts of the crimes are clear, and the evidence is reliable and sufficient; they shall therefore be held criminally liable for the crime of illegal business operations.
Defendants Wang Lin, Gao Yingjia, Yin Huibin, Wang Cong, Liu Zhenbin, and Lin Shucheng jointly and intentionally committed the crime of fraud. Defendants Wang Lin, Wang Zhong, and Wu Qiuyu jointly and intentionally committed the crime of illegal business operations. Pursuant to Article 25(1) of the Criminal Law of the People’s Republic of China, these are joint crimes.
Defendant Wang Lin played a principal role in the joint crimes of fraud and illegal business operations, and defendants Gao Yingjia and Yin Huibin played principal roles in the joint crime of fraud. Pursuant to Article 26(1) and (4) of the Criminal Law of the People’s Republic of China, they are principal offenders and shall be punished on the basis of all crimes in which they participated.
Defendants Wang Cong, Liu Zhenbin, and Lin Shucheng played secondary roles in the joint crime of fraud, and defendants Wang Zhong and Wu Qiuyu played secondary roles in the joint crime of illegal business operations. Pursuant to Article 27 of the Criminal Law of the People’s Republic of China, they are accomplices and shall be given lighter or mitigated punishment.
After being brought to justice, defendants Wang Lin, Gao Yingjia, Yin Huibin, Liu Zhenbin, Lin Shucheng, Wang Zhong, and Wu Qiuyu truthfully confessed their crimes. Pursuant to Article 67(3) of the Criminal Law of the People’s Republic of China, they have made truthful confessions and may be given lighter punishment. Where defendant Wang Lin has committed multiple crimes before the pronouncement of judgment, pursuant to Article 69 of the Criminal Law of the People’s Republic of China, a combined punishment for multiple crimes shall be imposed.
Defendant Wang Zhong voluntarily pleaded guilty and accepted punishment. Pursuant to Article 15 of the Criminal Procedure Law of the People’s Republic of China, he may be treated leniently.
Pursuant to Article 176 of the Criminal Procedure Law of the People’s Republic of China, this Procuratorate hereby institutes a public prosecution and respectfully requests that the Court adjudicate and impose sentence in accordance with law.

7月17日,王林、尹会彬、高颖佳、王聪、吴秋雨、汪中、林书铖、刘桢彬8位锡安的牧者同工,在辩护律师未获任何通知的情况下,被起诉至北海市银海区人民法院。这是公然的违法行为!

详情如下:
北京锡安教会“10·9”教案至今已进入第286天。
自2025年10月9日起,共有23位牧者及同工被羁押。目前,其中14位已取保候审,1位获检察机关决定不起诉并释放。截至今日,仍有8位牧者及同工被羁押于广西北海市第一、第二看守所,涉嫌“诈骗罪”及/或“非法经营罪”。案件已于2026年6月18日移送北海市银海区人民检察院审查起诉,并于7月17日在辩护律师毫不知情的情况下,被起诉至北海市银海区人民法院。
根据《人民检察院刑事诉讼规则》第二百六十一条规定:
办理审查起诉案件,应当听取辩护人或者值班律师、被害人以及诉讼代理人的意见,并制作笔录。辩护人或者值班律师、被害人及其诉讼代理人提出书面意见的,应当附卷。
《人民检察院刑事诉讼规则》第二百六十二条进一步规定,对于听取辩护人意见存在困难的,应当积极采取措施予以完成;确因客观原因无法听取的,应当将相关情况记录在案。
然而,本案承办检察官在未依法履行上述法定程序、未听取辩护律师意见的情况下,即将案件移送人民法院审判。该做法明显违反了《人民检察院刑事诉讼规则》的明确规定,严重损害了犯罪嫌疑人依法享有的辩护权利和诉讼权利。
案件近况
1、7月3日,金明日牧师已赴美国,与家人团聚。
2、7月17日,王林、尹会彬、高颖佳、王聪、吴秋雨、汪中、林书铖、刘桢彬等8位牧者同工,在辩护律师未获任何通知的情况下,被起诉至北海市银海区人民法院。
3、北海目前持续高温高湿。羁押人员长期居住于约四十平方米、容纳三十余人的监室内,居住环境拥挤,已有多人出现严重痱子、湿疹等症状。
4、部分患有严重疾病的牧者同工至今仍未获得必要的药物和医疗救治;申请营养餐亦遭拒绝,身体状况持续恶化。
5、8位牧者同工长期营养不足,普遍出现明显消瘦,健康状况令人担忧。
6、被羁押牧者同工依法享有的通信权利持续受到限制。

北京锡安教会“10·9”教案被羁押牧者同工家属团

The Beijing Zion Church “10·9” case has now entered its 286th day.
Since October 9, 2025, a total of 23 pastors and church workers have been detained. As of today, 14 have been released on bail, and 1 has been released after the procuratorate decided not to prosecute. 8 pastors and church workers remain detained in Beihai City No. 1 and No. 2 Detention Centers in Guangxi, charged with “fraud” and/or “illegal business operations.”
The case was transferred to the Beihai City Yinhai District People’s Procuratorate for review and prosecution on June 18, 2026. On July 17, without any prior notification to the defense lawyers, the case was formally indicted at the Beihai City Yinhai District People’s Court.
According to Article 261 of the People’s Procuratorate Criminal Procedure Rules:
When handling a case for review and prosecution, the opinions of the defender, duty lawyer, victim, and litigation representative shall be heard and recorded. Written opinions submitted by the defender, duty lawyer, victim, or their litigation representative shall be attached to the case file.
Article 262 further stipulates that if it is difficult to hear the defender’s opinions, active measures shall be taken to do so; if it is genuinely impossible due to objective reasons, the circumstances shall be documented.
However, the prosecutor handling this case transferred it to the court for trial without fulfilling these mandatory legal procedures or hearing the defense lawyers’ opinions. This action clearly violates the explicit provisions of the People’s Procuratorate Criminal Procedure Rules and seriously infringes upon the criminal suspects’ lawful rights to defense and due process.
Recent Developments
1 On July 3, Pastor Jin Mingri was released to the United States and reunited with his family.
2 On July 17, eight pastors and church workers — Wang Lin, Yin Huibin, Gao Yingjia, Wang Cong, Wu Qiuyu, Wang Zhong, Lin Shucheng, and Liu Zhenbin — were indicted at the Beihai City Yinhai District People’s Court without any notice being given to their defense lawyers.
3 Beihai is currently experiencing sustained high temperatures and humidity. The detainees are held in overcrowded cells of approximately 40 square meters containing more than 30 people. Many have developed severe heat rash, eczema, and other skin conditions.
4 Some pastors and workers with serious pre-existing medical conditions have still not received necessary medication or medical treatment. Requests for nutritious meals have been denied, and their health continues to deteriorate.
5 The eight detained pastors and workers suffer from long-term malnutrition and visible weight loss; their health is a serious concern.
6 Their legally entitled right to communication continues to be restricted.
Prayer Requests
1 Pray that God would lead all personnel involved in handling this case — including the special task force, detention center staff, and personnel in public security, procuratorial, court, judicial administration, supervisory departments, and relevant higher authorities — to have a heart of reverence, respect the national Constitution and laws, and treat the eight detained pastors and workers fairly, justly, and in accordance with the law.
2 Pray that God would personally watch over the physical health of the eight pastors and workers, healing all their illnesses and weaknesses.
3 Pray that God would grant them the same grace given to Daniel, so that even in a nutritionally deficient environment, they would be preserved by God — strong in body, with healthy complexions, and filled with wisdom and strength from the Lord.
4 Pray that God would strengthen the faith and strength of the legal defense team, protect their work, and watch over their families, shielding them from all disturbances.
5 Pray that God would care for every family member and child in their daily lives, personally comfort them, wipe away all their tears, carry their heavy burdens, and grant them peace and joy.
6 Pray that God would open doors in the media realm so that voices of fairness, truth, and freedom can be heard by more people, and that lies and deception would be removed.
7 Pray that, according to His will, God would soon release His servants and handmaidens, allowing them to return safely to their families and the church.
We condemn all actions that violate the rule of law and infringe upon citizens’ legitimate rights. We call on the relevant authorities to earnestly respect the rights granted to citizens by the Constitution and laws, and to handle cases lawfully and with judicial fairness.
We continue to pray urgently, longing for the fulfillment of God’s word:“But let justice roll on like a river, righteousness like a never-failing stream!” (Amos 5:24)
May light overcome darkness, and may justice and goodness be revealed in this land.
