🚨NEWS: The National Fraternal Order of Police, one of the key law enforcement groups involved in negotiations over the Blockchain Regulatory Certainty Act, is now backing the latest version of the Clarity Act, saying revised BRCA language addresses its previous concerns and preserves law enforcement’s ability to investigate crypto crimes. The BRCA remained unchanged in the latest version of the bill released Wednesday, so it’s unclear what changes the group is referencing.

1/ The updated Clarity Act text is here, reflecting a tremendous amount of work to get the details right. It creates new consumer protections, new tools for law enforcement, and most critically, it protects software developers, filling the gaps that exist in law today.

The Blockchain Regulatory Certainty Act (BRCA): Industry sources say the BRCA is unchanged from the version that cleared the Senate Banking Committee in May. It continues to clarify that non-custodial software developers and blockchain infrastructure providers are not treated as money transmitters solely because they build or maintain decentralized networks. The Lummis-Grassley amendment also remains, preserving existing federal criminal liability for anyone who “knowingly” facilitates illicit transactions. The Keep Your Coins Act is also intact, preserving individuals’ right to self-custody their own crypto.
